Starožitnosti AVA
Tyto Všeobecné obchodní podmínky a Aukční řád (dále jen „VOP") upravují pravidla provozu, průběhu a účasti na internetové aukci pořadatele Václav Vrba, Palackého 160/6, 28601 Čáslav, IČO: 40141098.
Navrhovatel – osoba, která navrhuje provedení dražby s využitím služeb Starožitnosti AVA.
Dražebník – osoba, která organizuje dražbu dle této dražební vyhlášky. Touto osobou jsou Starožitnosti AVA.
Dražitel – osoba, která má zájem o koupi předmětu dražby a účastní se dražby pořádané Starožitnostmi AVA.
Předmět dražby – movitá věc určená k dražbě, ke které je mezi dražebníkem a vydražitelem okamžikem příklepu uzavřena kupní smlouva.
Vydražitel – účastník dražby, jemuž byl udělen příklep.
Příklep – úkon zástupce dražebníka spočívající v klepnutí kladívkem nebo v ukončení dražby zastavením příjmu dalších příhozů v internetové dražbě.
První podání – možnost činit příhozy na všechny předměty uvedené v dražebním katalogu před samotným zahájením dražby. Nejvyšší příhoz v rámci prvního podání odpovídá nejnižšímu podání (vyvolávací ceně) v rámci samotné aukce.
VOP a Aukční řád – pravidla provozu internetového aukčního systému, průběhu dražby, podmínek účasti a užívání internetového aukčního systému.
Tento aukční řád je vydán za účelem organizace prodeje uměleckých předmětů Starožitnostmi AVA formou aukcí. Aukce jsou organizovány dle mezinárodních zvyklostí a v souladu s právem ČR. Jsou přístupné pro registrované klienty internetové aukční síně a další osoby se souhlasem dražebníka.
Za zprostředkování prodeje a nákladů na organizaci aukce náleží dražebníkovi provize 18 % z dosažené kupní ceny.
Účastí na aukci se každý zavazuje tento řád dodržovat.
Dražené předměty jsou označeny, popsány a mají uvedenou vyvolávací cenu v aukčním katalogu, který je nedílnou součástí dražby.
Dražené předměty, jejich popis, fotografie a vyvolávací cena jsou zveřejněny v internetovém aukčním systému. Dražitelé mohou činit příhozy před aukcí i během jejího průběhu v reálném čase.
Dražené předměty jsou staré a použité – mohou vykazovat známky opotřebení, poškození, restaurování apod. Taková poškození se v katalogu běžně neuvádějí. Veškeré informace o předmětech jsou informativní, dražebník neručí za jejich úplnost a správnost.
Vydražitel se vzdává práv z vadného plnění a uznává, že případné vady jsou zohledněny v příklepové ceně.
Dražba probíhá podle uvedeného pořadí v katalogu.
Dražebník si vyhrazuje právo zrušit dražbu nebo změnit její termín ze závažných důvodů.

Nedodržení pravidel může vést k blokaci účtu dražitele. 5. Úhrada a provize
Vydražitel je povinen uhradit cenu ihned po vydražení, nejpozději do 10 dnů po aukci. K příklepové ceně se účtuje 18% aukční poplatek. 6. Neuhrazení a smluvní sankce
Neuhrazení ceny do 30 dnů znamená zmaření dražby a zánik smlouvy. Dražebník je oprávněn účtovat úplatu a úrok z prodlení ve výši 1 % denně. Vydražitel nese náklady na vymáhání dlužné částky. 7. Registrace a účast v systému
Dražitel se účastní aukce online přes počítač či mobil. Účast je možná po registraci a schválení. Registrací dává dražitel souhlas ke zpracování osobních údajů dle zákona č. 101/2000 Sb. a GDPR. 8. Stav předmětů, odpovědnost a převzetí
Dražebník neodpovídá za barevné odchylky v katalogu ani za funkčnost předmětů. Elektrifikace nesmí být používána. Bezplatné skladné je poskytováno po dobu 20 pracovních dnů. Poté se účtuje 100 Kč/den za položku. Pokud skladné dosáhne výše ceny položky, může být položka znovu vydražena. 9. Přeprava a autorská práva
Náklady na dopravu hradí vydražitel. Riziko přechází na vydražitele předáním přepravci. Obsah webových stránek dražebníka je chráněn autorským právem. Kopírování bez souhlasu je zakázáno. 10. Dostupnost aukčního řádu

Starožitnosti AVA
These General Terms and Conditions and Auction Rules (hereinafter referred to as “GTC”) regulate the rules of operation, conduct, and participation in the online auction organized by Václav Vrba, Palackého 160/6, 28601 Čáslav, ID No.: 40141098.
Proposer is a person who proposes the execution of an auction using the services of Starožitnosti AVA.
Auctioneer is the person who organizes the auction under these Auction Rules. This person is Starožitnosti AVA.
Bidder is a person interested in purchasing the auction item and participating in the auction organized by Starožitnosti AVA.
Auction Item is a movable thing designated for auction, for which a purchase contract is concluded between the auctioneer and the successful bidder at the moment the hammer falls.
Successful Bidder is the participant to whom the auctioneer awards the item.
Hammer (Knockdown) means the act of the auctioneer’s representative consisting of a strike with a hammer, or in an online auction, the act of ending the auction by stopping the acceptance of further bids.
First Bid is the option to place bids on all items listed in the auction catalogue before the actual start of the auction. The first bid takes place in a fixed online auction. The highest bid within the first bid equals the lowest opening price in the live auction itself.
General Terms and Conditions (GTC) and Auction Rules regulate the operation of the online auction system, the course of the auction, as well as the conditions of participation and the use of the online auction system.
These auction rules are issued for the purpose of organizing the sale of artworks by Starožitnosti AVA in the form of auctions. The auctions organized under these rules are conducted in accordance with international customs in the art trade and with the legal norms of the Czech Republic. Auctions are accessible only to clients of the online auction house and other persons with the consent of the auction house.
The auction house means Starožitnosti AVA, Palackého 160/6, 28601 Čáslav, ID No. 40141098, which carries out auctions at the request of the owners of the auctioned items.
For the mediation of the sale and to cover the costs of organizing and conducting the auction, the auctioneer is entitled to a commission of 18% of the achieved purchase price.
These rules are binding on all participants in the auction, and by participating they agree to abide by them. The full text of the rules is available upon prior arrangement at Starožitnosti AVA, Palackého 160/6, 28601 Čáslav.
The auction items are identified and described, including the starting price, in the auction catalogue, which forms an integral part of these Auction Rules.
The auction items, including their descriptions, photographs, and starting prices, are published online, where the interested party must register and be approved by the auctioneer for the given auction.
Bidders may place bids before the auction during the entire period after the catalogue is published and/or bid in real time during the auction.
Auctioned items are old and used; therefore, they may show signs of age, use, storage, damage, or restoration. Minor defects (such as small chips, light scratches, negligible manufacturing flaws, scuffs, limescale, deposits, etc.) are not listed in the catalogue.
All information provided in the catalogue regarding authorship, attributed features, authenticity, quality, origin, date, age, provenance, condition, or estimated price only reflects the opinion of the auctioneer. No guarantees are provided.
The successful bidder expressly agrees that items are sold as artworks, with any defects already reflected in the hammer price. By placing a bid, the bidder waives all rights arising from defective performance (including under § 1916 of Act No. 89/2012 Coll., the Civil Code).
Claims are not accepted for items won in person at Starožitnosti AVA. Items purchased through power of attorney can only be claimed at the moment of collection.
Responsibility for ownership and the absence of third-party rights lies with the owner, not the auctioneer.
Ownership risk passes to the buyer at the moment ownership is transferred. After the auction ends, items are not covered by the auctioneer’s insurance.
Items are auctioned in the order (day, time) stated in the online catalogue.
Minimum bid increments:

CZK 200 – 500 → CZK 20
CZK 500 – 1000 → CZK 50

CZK 10000 – 20000→ CZK 1000
CZK 20000 – 50000→ CZK 2000

After the auction, bid records are archived in the system database for verification if needed.
Bidders violating the rules will be blocked and excluded. Bidders are responsible for providing accurate, truthful registration details.
The owner agrees that the auctioneer may promote the item widely, including outside the online system.
The buyer must settle payment immediately after the auction, but no later than the auction’s end. A 18% buyer’s premium applies to the hammer price up to CZK 1,000,000.
Payment can be made by bank transfer or cash upon collection, within 10 days of the auction unless otherwise agreed.
Failure to pay within 30 days results in cancellation of the sale, and the item is considered unsold. The auctioneer may then demand full compensation for services and interest of 1% per day on overdue payments. All collection costs are borne by the buyer.
Bidders may participate online after registration and approval. Registration implies consent to the processing of personal data in accordance with Czech law and EU GDPR.
The auction house is not responsible for misprints, color differences, or the functionality of items. Electrical wiring must not be used.
Storage of purchased items is free for 20 business days after the auction. After that, a storage fee of CZK 100/day/item is charged. If unpaid storage equals the hammer price, the auctioneer may cancel the contract and re-auction the item.
The risk of damage passes to the buyer if collection is delayed. Buyers must inspect items at collection and immediately report defects in writing.
All shipping and packing costs are borne by the buyer. The risk passes to the buyer once the item is handed over to the carrier.
Worldwide shipping is available and calculated individually based on the number of items purchased and total weight. All items are shipped safely from the Czech Republic with secure packaging to ensure they arrive in perfect condition.
All online content is copyright protected and may not be copied, reproduced, or shared without the auctioneer’s permission.
